Health and Safety in Lithuania: 12 Duties for a Vilnius Office

Vilnius has become one of Europe's more significant destinations for financial technology and shared services. Licensing has drawn payments and banking operations, and the cost and talent position has drawn engineering and support functions from groups headquartered elsewhere.

Lithuanian occupational safety law makes an unusual demand of those groups, and it arrives before anybody starts work. The person representing the employer has to have their health and safety knowledge tested by the state, before the business begins operating.

Twelve duties.

1. Your director sits a knowledge test before you trade

The provision with no counterpart anywhere else in this series.

Under the Law on Occupational Safety and Health, the knowledge of every employer who is a natural person, and of the person representing the employer as head of an undertaking, is tested by the State Labour Inspectorate under prescribed general provisions, before that person begins operating the undertaking or providing services.

Read that as written. It is not a training requirement that can be satisfied in the first year. It is a precondition to trading, and it attaches to the individual heading the Lithuanian entity rather than to the organisation.

A group appointing a country manager in Vilnius should treat this as part of the establishment sequence, alongside registration and banking, rather than as a health and safety item to be picked up later. The consolidated Act is published through the Lithuanian parliament's legal database.

2. Every undertaking appoints an OSH specialist

There is no exemption by size, only a variation in how many.

The Act requires every undertaking to appoint one or more occupational safety and health specialists, the number depending on the number of employees and the riskiness of the undertaking's activity, meeting the qualification requirements set in law. Their duty is to organise the preventive measures that secure safe and healthy working conditions.

3. Those specialists need higher education and a state test

The qualification bar is specific and it is not a short course.

Persons seeking to work as OSH specialists, and those providing OSH service functions to employers under contract, must hold higher education and meet the qualification requirements set by the minister. They are trained by education providers holding a permit from the Labour Inspectorate, and after training they must pass a knowledge test administered by the Inspectorate.

A group health and safety manager elsewhere in Europe does not hold this. As in Hungary, Greece, Colombia and Indonesia, the obligation attaches to who does the work as much as to the work itself.

4. Three routes to discharging the function

Depending on the size of the undertaking and the hazards to employees, the employer may establish an internal occupational safety and health service, hire an attested external service, or perform the functions personally, provided the person holds the corresponding education and training.

For a Vilnius entity of any scale, the external service route is the normal answer, and the provider must meet the qualification requirements above.

5. Time and workload must be proportionate

An obligation that echoes Slovakia and Austria without prescribing a figure.

Labour Inspectorate guidance is explicit that when the head of an undertaking sets the time for the specialist to perform their functions, they must satisfy themselves, applying criteria of reasonableness and fairness, that safety and health will actually be secured, having regard to the economic activity and the occupational risk at the workplaces. Where headcount changes, the workload or the number of specialists must change proportionately.

A retainer fixed when the entity had twenty people and untouched at two hundred does not meet that.

6. Risk assessment in every undertaking, with participation

The core obligation, and the participation element is specified rather than encouraged.

Occupational risk must be assessed in every undertaking. The employer organises the assessment, and it is carried out with the participation of employees or their representatives and the employee representatives for safety and health. Competent persons perform it, and quantitative measurements of chemical, physical and biological factors are carried out by an appropriate laboratory or testing body.

7. Psychosocial factors are expressly inside the assessment

The provision that matters most for a fintech or engineering operation.

The assessment must evaluate the risk to employees from each working environment factor: chemical, physical, biological, ergonomic, psychosocial and physical. Psychosocial risk factors have their own methodological guidelines issued jointly by the health and social security ministries.

That places Lithuania alongside France, Sweden, Denmark, Mexico, Colombia, Chile and Brazil in the group of jurisdictions where psychosocial risk is an express assessment category rather than a wellbeing consideration. For an operation whose real risks are workload and hours, that is where the substantive work sits.

8. Instruction is registered, and the first entry happens immediately

Lithuanian practice runs on a structured instruction regime with registers.

Introductory instruction is compulsory for every person newly employed. It must be carried out and recorded in the undertaking's introductory instruction register immediately upon conclusion of the employment contract. Primary instruction at the workplace follows, and periodic instruction thereafter at intervals the employer sets.

Employees who have received primary instruction may only begin work once that instruction has been properly recorded. A group onboarding process that issues a digital module and no register entry does not meet this.

9. The employer writes its own safety instructions

Beyond the assessment, the employer prepares occupational safety and health instructions, which have the status of local normative acts within the undertaking.

They identify the actual and potential risk factors at the workplace and in the working environment, and set out safe working methods. Which instructions a particular workforce needs is a decision for the employer, made having assessed the risk factors at the workplaces.

10. Health checks happen in working time, at your cost

Mandatory preventive health checks apply to employees under eighteen on employment and annually until they turn eighteen, and to employees whose workplace risk assessment results show that a risk to safety and health arises or may arise, before employment and periodically thereafter.

Two details a foreign parent should note. The checks take place during working time and the employer pays average wage for it. And where a check is not carried out at the scheduled time for reasons outside the employee's control, the employee has the right to refuse to work because of the potential danger to their health.

11. Agency and temporary workers carry host duties

Relevant because so many Vilnius operations use agency staffing.

Before a temporary worker starts, the user undertaking must inform them of all possible risk, state the professional qualification, skill and health surveillance requirements, and clearly identify any specific increased risk. It may only allow work to begin once the worker has been made familiar with the applicable requirements, including existing and potential risk factors, and has been instructed to work safely at that specific workplace, even if the agency has already instructed them.

The user undertaking must also notify its OSH specialist and the employee safety representative.

12. Representation, and people you send elsewhere

Two closing obligations.

Employees have representatives for safety and health, and undertakings operate an occupational safety and health committee, whose regulations are agreed through a defined process. Confirm the threshold and composition applicable to your entity, since these turn on provisions that are amended and are reported inconsistently in circulating guidance.

Separately, employees performing services at other undertakings must receive instruction from their own employer's authorised person, together with information about the internal working rules of the undertaking being served, the specifics of the forthcoming work and its potential hazards and risks. For a consultancy or a support function attending client premises, that is a specific and easily missed requirement.

Rows one and two are the sequence. The first is a precondition to operating and the second is what everything below it depends on.

The Baltic and central European picture

Lithuania completes a set of eight jurisdictions in this region covered across the series, and the variation within it is the point.

Poland requires a medical certificate and training before admission to work. The Czech Republic categorises every job and notifies the outcome. Romania requires a handwritten training record. Hungary reserves risk assessment to a qualified specialist. Bulgaria requires an occupational medicine service from the first employee and an annual filing. Slovakia requires both preventive services and an annual joint assessment. Estonia files the analysis into a state database. Lithuania tests the director before trading.

Eight countries, eight mechanisms, all deriving from the same EU Framework Directive 89/391/EEC. EU-OSHA publishes an overview of the Lithuanian national system.

A group that has produced one regional pack has a document that is wrong in eight places rather than right in one. What travels is the methodology, the register and the review cycle.
