Risk assessments · Officer due diligence support · DSE and ergonomics · Ongoing compliance under the Health and Safety at Work Act 2015 and WorkSafe New Zealand · Auckland, Wellington, and Christchurch

New Zealand rebuilt its workplace safety regime after the Pike River mine disaster, producing the Health and Safety at Work Act 2015, which shares its core architecture with the Australian model: the person conducting a business or undertaking (the PCBU) and a personal due diligence duty on officers. For international and UK-headquartered groups with New Zealand operations, the framework is recognisable in principle but specific in its terminology and its expectations of directors. Arinite provides Qualified consultants and compliance software to businesses operating in New Zealand, coordinating obligations with group standards across 50+ countries.

ABOUT

Workplace Health and Safety
in New Zealand

The Health and Safety at Work Act 2015 (HSWA) is the principal workplace safety statute in New Zealand, administered and enforced by WorkSafe New Zealand, the national regulator. The Act came into force in 2016 following the reform process that followed the Pike River tragedy, and it deliberately aligns with the Australian model WHS framework. Several features matter for any business operating in New Zealand:

The PCBU duty

As in Australia, the primary duty of care sits with the person conducting a business or undertaking, a broad concept extending beyond the traditional employer.

Officer due diligence

Officers, including directors, have a personal duty to exercise due diligence to ensure the PCBU complies with its duties. Officers are expected to be able to demonstrate the steps they have taken.

Reasonably practicable

Duties are framed around what is reasonably practicable to manage risk.

Worker engagement

HSWA places specific emphasis on worker engagement, participation, and representation.

Notifiable events

Certain events must be notified to WorkSafe New Zealand.

Arinite provides Qualified consultants and compliance software to businesses operating in New Zealand, with particular strength for UK and international groups that need their New Zealand operations to meet HSWA and WorkSafe expectations while staying consistent with a single group compliance system.
