International Health and Safety Consultants for Multinational Businesses

Global Health and Safety Compliance Across 50+ Countries

Managing international health and safety compliance is one of the biggest challenges facing multinational organisations. There is no single global health and safety law — each country sets its own workplace safety regulations, from OSHA compliance in the United States to the EU Framework Directive (89/391/EEC) across Europe.

Arinite's international health and safety consultants help organisations build a global health and safety management system that satisfies local legal requirements in every jurisdiction, aligned with ISO 45001 and international safety standards.

Whether you need international EHS compliance support, health and safety legal registers for multiple countries, or a competent person for overseas operations, our IOSH Chartered consultants deliver one global framework adapted to local law everywhere.

WHY INTERNATIONAL IS DIFFERENT

If you operate internationally, three things are true:

1

There is no single global Health & Safety law

2

ISO 45001 does not replace local legal duties

3

Directors and senior managers can face personal liability in multiple jurisdictions

How Health & Safety Law Differs by Country

There is no single international Health & Safety law.

European Union

EU member states follow the EU health and safety directive Framework Directive (89/391/EEC), but each country transposes it into national law in different ways.

This means:

  • Documentation requirements vary by country
  • Risk assessments must often follow local formats
  • European workplace safety regulations are interpreted and enforced nationally

For example:

  • France requires a Document Unique d'Évaluation des Risques Professionnels (DUERP) — French health and safety regulations mandate this
  • Germany requires the appointment of a Fachkraft für Arbeitssicherheit and occupational health physician (Betriebsarzt) — German occupational health and safety law (Arbeitsschutzgesetz)
  • Netherlands requires a RI&E (Risico-Inventarisatie en -Evaluatie) under the Dutch Arbowet (Working Conditions Act)
  • Spain requires prevención de riesgos laborales (PRL) documentation and appointed preventive resources
  • Eastern European countries often require additional registers, training records, and inspections that are not recognised in the UK
🇺🇸

United States

The US operates under OSHA (Occupational Safety and Health Administration) at the federal and state levels

OSHA compliance requirements include:

  • Mandatory OSHA recordkeeping requirements (Forms 300, 300A, 301)
  • State OSHA plans with additional requirements beyond federal OSHA
  • Prescriptive OSHA compliance standards rather than risk-based systems
  • US workplace safety regulations differ significantly from UK

UK or EU documentation alone is not sufficient for OSHA compliance in the US.

THE RISK

The Risk of Getting It Wrong

International enforcement is not theoretical. Directors, senior managers, and organisations face real consequences for non-compliance:

Legal Consequences

  • Criminal prosecution of directors and managers in multiple jurisdictions
  • Personal liability for failures in systems or oversight
  • Corporate manslaughter prosecution (UK Corporate Manslaughter and Corporate Homicide Act 2007 can apply to overseas deaths)
  • Custodial sentences in serious cases (particularly in Germany, France, and Italy)

💰Financial Impact

  • Unlimited fines in many countries for serious breaches
  • Personal fines levied on individuals alongside corporate penalties
  • EU and US regulators actively enforce cross-border violations

🏢Operational Risk

  • Immediate shutdown of operations during enforcement action
  • Legal prohibition from operating until compliance demonstrated
  • Mandatory corrective action plans with strict timelines

📉Reputational Damage

  • Public prosecutions reported in national and international media
  • Loss of contracts, clients, and tenders requiring proof of compliance
  • Investor and shareholder scrutiny following enforcement

The cost is rarely just financial. It's organisational.

The Arinite Approach

We don't apply UK systems globally and hope for the best.

We design one global framework, then adapt it to meet local legal requirements in each country.

What This Means in Practice

One global health & safety manual

Local legal compliance is layered underneath

Clear accountability at the group and site level

Consistent reporting and assurance

Evidence regulators recognise

This allows senior leadership to see risk clearly without managing compliance on a country-by-country basis.

ISO 45001: Useful, But Not Enough

ISO 45001 provides a framework, not a legal local compliance standard.

We help organisations:

  • Use ISO 45001 as a consistency tool
  • Align it with local legislation
  • Avoid the false confidence that certification alone can create

Certification supports compliance. It does not replace it.
